Terms and Conditions

  • Checks should be made payable to: The New York City Wiccan Family Temple, Inc.. All payments made under this contract are non-refundable. The Festival will be held as scheduled RAIN OR SHINE.
  • Booths should be made to look Summer Solstice themed – (your choice): wood nymphs, faes, sprites, fairies etc. in nature, theme, or style as possible. Vendor MUST wear chosen-style costumes. All other costume styles and attire, including, aliens, cowboys, will be deemed inappropriate.
  • No items, food, or drinks may be added or deleted at the Festival without advance approval by the Producer. ALCOHOLIC BEVERAGES MAY NOT BE SOLD OR DISPENSED BY VENDOR. VENDOR MAY NOT SELL ANY TYPE OF TOBACCO PRODUCT, DRUG PARAPHERNALIA, OR OBSCENE MATERIALS.
  • This agreement entitles Vendor to one 10 ‘ x 12’ vendor’s space as assigned by Producer, and the assignment may not be changed without Producer's permission. Vendor may not subcontract to other individuals or businesses to sell, offer, or display, additional products or services, nor shall Vendor substitute items or services listed above (in Food Vendor application) without the Producer’s express advance consent. Vendor must occupy assigned spaces only and must confine his or her activities and all merchandise, equipment, cases, and/or packing materials within marked boundary lines.
  • You will be notified of space number assigned in advance. Space is assigned on a first come first served basis.
  • Vendor must supply his or her own booth, equipment, containers, tables, chairs, display, electricity, water or ice required, or anything else required to function. Set up begins at 7:00 AM on the day of the Festival. Display must be attended at all times during selling hours, and Vendor MUST be ready for customers NO LATER than 10:00 A.M. Display must be in good taste, kept tidy, and all modern equipment, packaging, etc. must be kept out of public sight. Vendor is responsible for maintenance and clean up of space during and upon conclusion of Festival and for keeping space free from any conditions which might be dangerous to persons coming into the Park. Vendor must provide his or her own trash bags and is responsible for removal and disposal of trash bags and for complying with applicable NYC recycling law.
  • No vehicles will be permitted on the Festival Grounds between 10:00 AM and 8 PM. Unauthorized vehicles will be towed away at the owner's expense. Upon arrival at the Festival, Vendor will receive one parking permit which will be valid for parking one vehicle off-site. But for exceptional circumstances, all parking will be assigned off-site. THERE IS ABSOLUTELY NO PARKING WITHIN THE PARK! (HAVE TO CHECK ABOUT PARKING ON 17TH STREET AND ON CERTAIN AREAS OF THE PARK)
  • In consideration of the privilege of attending the Festival, and payment of the application fee which is less than the actual prorated costs of the Festival, Vendor, on behalf of his or her respective relatives, heirs, assigns, executors, and administrators (collectively Vendor) hereby permanently and irrevocably waives any and all actions, claims, demands, suits and proceedings of any kind and nature against NYC Wiccan Family Temple as Producer of the Festival, and against the City of New York Department of Parks and Recreation, and their respective officers, directors, representatives, agents, consultants or employees, affiliates, predecessors, successors in interest and assigns arising out of direct or indirect action of any kind or nature, whether now known or hereafter discovered, and Vendor, by his or her signature hereon, forever releases and discharges Sponsors from any losses, liabilities, damages, costs or expenses, including, without limitation, reasonable attorneys' fees (collectively "losses") with respect thereto. Vendor further agrees that he or she will indemnify, defend, save, and hold harmless Sponsors from any losses sustained by them that directly or indirectly result from or arise out of any action or failure of action by Vendor.
  • If Vendor violates any of the terms and conditions of this agreement, he or she may lose the privilege of participating in the Festival, without refund.
  • In the event of continuous and torrential downpour on the day of the Festival, or any other circumstances beyond the control of Producer of the Festival shall continue with Festival as scheduled and vendors will continue as contracted and will not be refunded.
  • This contract may not be assigned by Vendor to any other party, nor may the space or location be shared with another party or vendor without the expressed written approval of Producer. This contract shall be governed by the laws of the State of New York. If any term or provision of this agreement shall be held illegal, unenforceable, or in conflict with any law governing this contract, the validity of the remaining portion shall not be affected thereby.
  • This is a fully integrated contract. It is further understood that this contract contains the whole agreement between Vendor and Producer.
  • Food production in public spaces poses many challenges and we would like to offer some reminders to keep your food safe and sanitary. • Food can not be stored on the ground; it must be at least 6" off the ground. • Egg products such as custard are not permitted at street events. • Perishable foods (poultry, meat & fish, dairy) should be stored out of the danger zone of 41°F-140°F. Hot foods should be hot and cold foods should be cold. • Perishable raw foods should never be stored over cooked or processed foods; any dripping or leaks could cause cross-contamination. • Vendors should have some method of sanitizing their tools and their hands. Please have a tub handy with water for washing serving utensils. • Vendors must educate their workers on proper food sanitation and personal hygiene. Vendors have dropped utensils on the ground and not wash them, blow their nose and not wash their hands, etc. Please realize that the public sees this as well. One food poisoning incident can taint the Festival and will undo all of our hard work.
  • • a copy of the license or permit from the kitchen in which the food was prepared. • a copy of a food handling certificate. • a copy of the NYC permit for 1 day events.
